No doubt ruling contrary to shariah is a major sin of itself and is almost the level of kufr. But our discussion is whether the whole state/country becomes Darul Kufr as a result (such as Saudi Arabia, Kuwait, Qatar etc).

Man-made constitutions don't nullify Darul Islam while major signs of Islam are still present
Shaykh Ibn Uthaymin (r) in his Hashiya of al-Kafi (5/297) [an important manual of Jurisprudence] :
ما هي دار الإسلام ودار الكفر فهل إذا كانت هذه البلدة شعائر الإسلام فيها ظاهرة من آذان وصلاة جماعة وجمعة وصيام وأعياد وكل شعائر الإسلام فيها ظاهرة لكن حكامها يحكمون بالقانون عمداً وقصداً فهل نقول هذه بلاد إسلام أو بلاد كفر؟ نقول هي بلاد إسلام لأن المظهر فيها مظهر إسلام وإذا قصَّر الحكام أو اعتدوا فإن ذلك لا ينقلها إلى دار الكفر
وأما ما هيمن عليه الكفرة فهي دار كفر وإن كان يوجد فيها من يحكم بالإسلام، فهذا هو تعريف دار الإسلام
"What is Dar al-Islam & Dar al-Kufr? If the (major) signs of Islam is evident in these countries, such as adhan, congregational prayers, Friday prayers, fasting, Eid & all the signs of Islam are evident but the rulers deliberately & intentionally rule by man-made constitutions, should we consider it Dar al-Islam or Dar al-Kufr?
We would consider it Dar al-Islam because the (major) signs of Islam are apparent and rulers falling short of implementing all of shariah doesn't convert it to Dar al-Kufr.
As for the state where (signs of) kufr is predominant then its Dar al-Kufr, even if Islamic constitution is found in it. This is how Dar al-Islam is known.
What if the ruler is a kafir but population are Muslims?
Sh. Ibn Uthaymin continues (ibid):
فدار الإسلام ما ظهرت فيها شعائر الإسلام وكان أهلها مسلمين بقطع النظر عن الحكام والحكام لهم شأنهم وبه نعرف خطاء من يقولون في بلاد المسلمين التي يحكم فيها حكامها بالقانون إنها بلاد كفر فهذه مسألة خطيرة.
Dar al-Islam is where the (major) signs of Islam are present & its inhabitants are Muslims, it does not matter if the ruler is a Muslim or not, the ruler is not looked at. The case of a ruler is different. That's how we know the mistake of those who claim that lands of Islam containing man made constitutions are Darul Kufr.
He said the same in Tafsir Surah al Ankabut:
وأما قول من يقول : إن بلاد الإسلام هي التي يحكمها المسلمون، أي : يكون حكامها مسلمين، فهذا ليس صحيح.
Those who claim Darul Islam is a country ruled by a Muslim are wrong
Ok, what if signs of both Islam & Kufr are present?
Sh. continues in Tafsir al-Ankabut (pg. 336-337):
ولكن إذا كان يظهر فيها شعائر الإسلام وشعائر الكفر، كما لو كانت تقام فيها الجمع والجماعات، ولكن يسمع فيها أيضا أبواق اليهود ونواقيس النصارى، وتقام فيها صلوات النصارى واليهود، ففي هذه الحال نرجع إلى الحكام والأغلبية، لأن الحاكم قد يعجز عن إزالة شعائر الكفر، فإذا كان غالب البلد مسلمين وحكامها مسلمون، قلنا: هذه بلاد إسلام وإن كان فيها شيء من شعائر الكفر؛ لأن الغلبة كمية وسلطة للمسلمين، ولكن يعجزون عن إزالة شعائر الكفر؛ لأن إظهار شعائر الكفر في بلاد المسلمين لا يجوز ويجب منعه، حتى إظهار الصليب ممنوع في بلاد الإسلام، فكون الصليب يرفع على الكنائس أو في الطرقات هذا ممنوع في بلاد الإسلام.
But what if signs of both Islam & kufr are evident in a country; for instance: it has congregational & Friday prayers but also the Christian Church bells are heard & so are Jewish Shofar (Jewish musical sound for religious rites) and their prayers are carried out in public? In that case we look at the ruler & the majority of the population. Because sometimes a ruler is incapable of fully eradicating major signs of kufr in a country.
So if majority of population are Muslims & the ruler is also a Muslim then we say this is Dar al-Islam even if some signs of kufr are remnant. Because Muslims are dominant there in number & strength but unable to remove some remnants of kufr. Because public display of signs of kufr is haram in a Muslim country and suppressing them is Wajib. In fact its even haram to display the Christian Cross in public. Thus displaying the Cross atop Churches is forbidden in a land of Islam
