Salaam. My question is sort of in two parts but they are connected and I need help understanding something. I have been reading Islamqa and Islamweb viewpoints on weather the ruler who rules according to man made law due to his desire is considered to be a kafir or not. The scholars have stated that the one who governs a law other then Allah in terms of legislation and not in personal situations is considered to have committed major kufr and the scholars usually have said "this is because the ruler preferred these laws over Allah and thinks these laws are better then Allahs laws" but what about if it was out of pure desire, as in the ruler knows Allahs laws is the best and should be used yet does not rule by Sharia because of his own whims and desires?
The second part of the question is related to the title and concerns a lot of Muslims especially the youth who play video games or use other entertainment websites or when ever you download a video game from a website or some other form of entertainment apps for example discord or you use Netflix, YouTube, Facebook etc, 99% of the time it has an agreement which states things like in any breach in the agreement or dispute you would be taken to court or you have to follow the law of the countries like United States or any other man made law court of a country. You obviously have to tick the "I consent to the terms and conditions of the agreement" in order to download the game or view the service being provided, does this come under referring to Judgement other then Allah. I have seen similar questions to this on Islamqa and Islamweb and an overall conclusion is that if the programme is required then one may use it for example Microsoft word or google chrome, these software are pretty much essential so one can sign the agreement as "Allah wants to make things easy for us" but what about programmes which one does not need such as these movie sites or video game companies and other forms of entertainment, pretty much millions of Muslim Youths have signed these agreements and I doubt this takes every one out of the fold of Islam but still we are pretty much consenting for the cases to be judged by man made laws although the intention of the Muslim is just to play games or view the entertainment but still is signing such a condition regarded as kufr?
